1. Contract Confirmation and Booking A. This contract constitutes the legally binding agreement between The Hire Barn ("The Hire Barn") and the client. Please carefully review and our T&Cs before confirming your booking. B. Booking confirmation requires payment of the booking deposit (25% of total fee) within seven (7) days from the date of this agreement. The remaining booking fee is due no later than thirty (30) days prior to the event. C. Failure to pay the remaining booking fee within the specified time may result in termination of your booking, with the deposit retained as compensation. D. Non-receipt of the deposit within seven (7) days after issuance of the booking form and/or invoice releases The Hire Barn from any further obligations. 2. Liability and Responsibilities A. The client is responsible for the full replacement cost of any lost or damaged equipment, in addition to forfeiting the security deposit, as determined by The Hire Barn after damage assessment. B. The client must ensure the event venue provides a safe power source (if required) and suitable area for equipment setup. Any venue-specific requirements should be communicated to The Hire Barn prior to equipment delivery. C. The client must arrange free parking for The Hire Barn’s vehicles associated with equipment delivery and collection. If no free parking is available, the client is liable for any incurred parking charges payable to The Hire Barn. D. The equipment provided by The Hire Barn is solely for use during the agreed event period. Unauthorised use by any other parties before, during, or after the event is strictly prohibited. E. The client, client’s guests, or third parties must not move or handle the equipment without prior permission from The Hire Barn. Any damage resulting from unauthorised handling is the sole liability of the client. 3. Outdoor Equipment and Safety A. Outdoor equipment, such as games, must be protected from adverse weather conditions (e.g., strong wind, snow, rain). The client is responsible for moving the equipment to a sheltered area during inclement weather to prevent damage. B. Heavy equipment poses injury risks if moved improperly. The client, client’s guests, or third parties must refrain from moving the equipment to avoid injury or damage, which may result in additional charges. 4. Equipment Use Guidelines A. Clients and their guests must refrain from touching hot bulbs in any equipment to prevent injury. The Hire Barn is not liable for injuries resulting from improper use of equipment. B. Resting items such as drinks or food on equipment is strictly prohibited. Any damage or cleaning costs incurred due to such actions may result in the loss of the deposit. 5. Equipment Provision and Setup A. The Hire Barn is responsible for providing equipment in good working order and ensuring their safety. All equipment undergoes annual PAT testing, and The Hire Barn maintains Public Liability Insurance with a maximum cover of £1,000,000. B. Unless otherwise agreed, The Hire Barn is responsible for transporting and setting up equipment at the client’s specified location, ensuring safe installation as per their discretion. 6. Safety, Supervision, and Liability A. Responsibility for Safety. The client acknowledges and agrees that they are fully responsible for the safety and well-being of all guests while using the games and equipment provided by The Hire Barn. This includes, but is not limited to, ensuring that all equipment is used correctly and as intended. B. Supervision of Children. The client must ensure that children are always supervised by a responsible adult when using any games or equipment. The Hire Barn shall not be held liable for any injuries or accidents that occur due to a lack of supervision. C. Proper Use of Equipment. The client agrees to use all games and equipment in accordance with the provided instructions and guidelines. Misuse of the games and equipment, which could result in damage or injury, is strictly prohibited. The Client will be liable for any injuries or damages resulting from improper use of the equipment. D. Use at Own Risk. All guests use the games and equipment at their own risk. The Hire Barn is not responsible for any injury or damage to persons or property resulting from the use of the games and equipment. E. Liability for Damages. The client shall be responsible for any damage to the games and equipment caused by improper use, negligence, or lack of supervision. In such cases, the Client will be liable for the full cost of repair or replacement of the damaged items, as assessed by The Hire Barn. F. Damage to Lawns. The Hire Barn shall not be held responsible for any damage to lawns, grass, or any other outdoor surfaces caused by the use of the games and equipment. The Client accepts all responsibility for any such damage that may occur during the period of hire. G. Indemnification and Notification. The client agrees to inform all guests that The Hire Barn is not liable for any injury or damage to persons or property resulting from the use of the games and equipment. If the client fails to inform their guests of this, the Client will assume full liability for any resulting claims or injuries. The Client shall indemnify and hold harmless The Hire Barn from any claims, damages, or losses arising from the Client's failure to inform their guests. Uncontrollable Circumstances and Changes A. Uncontrollable Circumstances. In the event of traffic or other uncontrollable circumstances preventing The Hire Barn from being able to fulfill our contracted obligations, our liability shall be limited to a refund of any monies paid in relation to the contracted event or a prorated reduction in the hire fee in the event of a delayed start. No further compensation will be paid, irrespective of any loss of earnings. B. Changes to Booking. Where a request is made to change the date, time, or venue of hire, The Hire Barn will do our best to rearrange the booking. All deposits are non-refundable. The cancellation policy as stated in these conditions will apply. C. Right to Refuse Delivery. The Hire Barn reserves the right to refuse delivery if the venue or site is deemed unsuitable by our personnel or if the Client has failed to notify The Hire Barn of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the setup site. In such cases, no refund will be given. 6. Dispute Resolution and Cancellation A. Any dispute or complaint must be submitted in writing (via email) within twenty-eight (28) days after the event. Both parties will seek to resolve the issue amicably; unresolved matters may require legal intervention. B. The client may cancel this contract within fourteen (14) days of booking confirmation and receive a full deposit refund if no equipment or services have been provided. Beyond this period, cancellation fees apply as outlined below:
90 days or more before the event: 50% of the total remaining booking fee.
89 to 61 days before the event: 75% of the total remaining booking fee.
60 days or less before the event: 100% of the total remaining booking fee.
C. Cancellation fees must be paid within fourteen (14) days of the invoice date. Failure to do so may result in legal action and additional charges.
